In August of 2010 Johnson & Johnson has recalled approximately 93,000 DePuy ASR™ hip replacement joints. You may have received a recall notice from them. A high percentage of these joints have or are failing, causing pain and loss of mobility and the need for expensive surgery to replace the joint. Why are DePuy ASR™ hip implant joints being recalled?
DePuy ASR™ hip joints are metal on metal joints. On many of the joints, the metal is wearing down and small particles are being released into surrounding tissue. These metal particles may cause damage to the tissue around the joint may results in vasculitis, pseudotumors, and necrosis. Due to this damage, studies have shown that subsequent hip replacement surgeries have lower success rates.
When were the defective DePuy ASR™ hip joints used?
DePuy ASR™ hip joints were first used around 2005. After a few years they realized that there were problems with the hip joints and people quit using them, but some were sold through 2010.
What should I do if I think I have a DePuy ASR™ hip replacement joint?
If you think you are suffering from a defective DePuy ASR™ hip replacement joint, you need to see your doctor as soon as possible and make sure that you have a DePuy ASR™ joint. If you do and it is subject to the recall, you need to talk to your doctor about hip replacement.
Patients with radiographic changes indicative of product failure should be addressed according to normal procedures. All other patients should be followed [...] a small number of patients may develop progressive soft tissue reactions to metal wear debris. The debris can cause soft tissue damage which may compromise the results of the revision surgery. Early revision of poorly performing hip replacements that generate metal debris should give a better revision outcome. Therefore metal ion testing should be considered in cases where the surgeon is concerned about the hip replacement. [recall announcement]

DePuy is a subsidiary of Johnson & Johnson, a multi billion dollar company. Sales of faulty DePuy ASR™ hip joints helped Johnson & Johnson in profiting over $4 billion dollars in just one quarter in 2010.
What are my rights?
Hip replacement is expensive, painful surgery with many weeks of recovery and physical therapy. If you need surgery as a result of a failed DePuy hip joint, DePuy should be liable for any costs associated with surgery and aftercare, as well as compensation for your pain and suffering.
DePuy offered to pay some of my medical costs, why do I need a lawyer?
DePuy wants to pay you the least they can get away with. You need to make sure that all of your surgery costs, recovery costs, and lost wages are covered. Whatever medical costs that DePuy does not cover can end up coming out of your pocket. DePuy does not want to pay you for pain and suffering. Due to their faulty product, you will have to undergo a painful surgery and months of aftercare. You are entitled to compensation for this pain and suffering.

If you agree to have DePuy just pay the deductibles and co-pays, it is possible that your insurance company could sue you for the rest.
